General provisions

• This User Agreement (hereinafter referred to as the Agreement) refers to the website located at houseupp.com.
• Website "houseupp.com " (hereinafter referred to as the Site) is the property of HouseUpp.
• The Agreement regulates the relations between HouseUpp (hereinafter referred to as the Agency) and the Site user (hereinafter referred to as the User) arising from the use of the Site.
• The Agency reserves the right to change, add or remove clauses of the Agreement at any time without notifying the User.
• The full and unconditional acceptance of the Agreement by the User is the User's actions aimed at using the Site, including searching, viewing, studying the content of the Site, sending messages through the feedback form and other communication channels posted on the pages of the Site, as well as other actions for using the services of the Site.
• The User is personally responsible for checking the Agreement for changes in it.

Terms and definitions

Subject of the agreement

Rights and obligations of the parties

• The Agency has the right to:

• The User is prohibited from:

Use of the site

• The Website and the Content included in the Website belong to the Agency and are managed by it.

Responsibility

• Any losses that the User may incur in the event of intentional or negligent violation of any provision of the Agreement, as well as due to unauthorized access to the communications of another user, the Agency will not be reimbursed.
• The Agency is not responsible for:
  • Delays or failures in the process of the User's work with the Site that has arisen due to the occurrence of force majeure circumstances, as well as any case of malfunctions in telecommunications, computer, electrical, and other related systems.
  • Proper functioning of the Site, if the User does not have the necessary technical means for its use, and also does not bear any obligations to provide the User with such means.
• Limitation of the Agency's liability:
  • All rights to the Site and the materials contained on it are protected, and violation of rights is prosecuted by the law.

The facts and figures indicated on the Website are valid only at the time of their publication on the Website and may change over time due to objective circumstances. The deadlines indicated on the Website or in the news for the commissioning of real estate and the settlement of residential real estate are estimated; during construction, the deadlines may be adjusted by developers at any time without any prior notice.

The prices shown on the Website are also not final. The owner (copyright holder)/the developer may change them at any time without any prior notice. The price of the contract is formed based on the conditions for the acquisition of a specific real state object and is determined by the owner (copyright holder)/by the developer directly when signing a contract with a specific client.

To avoid misunderstandings, the User needs to clarify with the Agency staff the key information about the selected property, namely:

• the final cost, taking into account the current discounts and promotions, as well as the payment method and other terms of purchase;
• the deadline for the delivery of the object (if the real estate object is not put into operation);
• location and layout of the property, total area, availability and area of summer premises (balconies, loggias, terraces, and verandas), number and area of premises rooms) as part of the property, and other information;
• the condition of the finishing of the property, its equipment with furniture, appliances, plumbing, and other equipment, etc.;
• other important information for the User.

Violation of the terms of the User Agreement

• The Agency has the right to disclose any information collected about the User of the Site if the disclosure is necessary for connection with an investigation or complaint regarding the misuse of the Site or to establish (identify) a User who may violate or interfere with the rights of the Agency or the rights of other users of the Site.
• The Agency has the right to disclose any information about the User that it deems necessary to comply with the provisions of current legislation or court decisions, to nsure compliance with the terms of the Agreement, and to protect the rights or safety of the Agency, Users.
• The Agency has the right to disclose information about the User if the current legislation requires or permits such disclosure.
• The Agency has the right to terminate and/or block access to the Site without prior notice to the User if the User has violated the Agreement or the terms of use of the Site contained in other documents, as well as in the event of termination of the Site or due to a technical malfunction or problem.
• The Agency is not liable to the User or third parties for termination of access to the Site in case of violation by the User of any provision of the Agreement or other document containing the terms of use of the Site.

Dispute Resolution

• In case of any disagreements or disputes between the Parties to the Agreement, a mandatory condition before applying to the court is the presentation of a claim (a written proposal for a voluntary settlement of the dispute).
• The recipient of the claim within 30 (thirty) calendar days from the date of its receipt, notifies the applicant of the claim in writing about the results of the consideration of the claim.
• If it is impossible to resolve the dispute voluntarily, either Party has the right to apply to the court for protection of their rights, which are granted to them by the current legislation.
• Any claim regarding the terms of use of the Site must be filed within the period from the moment the grounds for the claim arise, except for copyright protection for the materials of the Site protected by the legislation. In case of violation of the terms of this clause, any claim or grounds for action are extinguished by the statute of limitations.
